Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Hoame (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Hoame is
Hoame is a software platform that lets homeowners’ associations (“Associations”) manage their communities — including members and approvals, units and ownership, dues and assessments, documents, and communication. Hoame is a tool. We are not a property manager, financial institution, or legal advisor, and we are not a party to any relationship between an Association and its members. Payments and money are handled entirely off the platform; Hoame does not process payments or hold funds.
2. Eligibility
You may use the Service only if you are at least 18 years old (or otherwise of legal age to form a binding contract in your jurisdiction) and you are an authorized member, owner, or representative of an Association. By using the Service you represent and warrant that you meet these requirements.
3. Accounts
- You join an Association through an invitation or approval process it controls.
- You are responsible for the accuracy of your account information and for keeping your password and any two-factor authentication secure.
- You are responsible for all activity under your account. Notify us promptly of any unauthorized use.
4. Dues & financial records
Hoame provides a per-unit ledger so Associations can record dues and assessments. Payments are recorded manually by the Association — Hoame does not process payments, hold funds, or handle money. Any dispute about amounts owed, payments, or balances is between you and your Association. Hoame does not verify the accuracy of the financial records an Association maintains in the Service.
5. Association responsibilities
Each Association — not Hoame — is responsible for the accuracy of its dues and financial records, its governing and enforcement decisions, and its compliance with all applicable HOA and community-association laws and its own governing documents. Hoame is a neutral software tool and does not provide property management, financial, accounting, or legal services.
6. Association administrators’ responsibilities
If you administer an Association, you are responsible for your own legal compliance — including recordkeeping, notices, and all applicable federal, state, and local laws governing community associations. You are responsible for your interactions with your members and for the accuracy of the content, records, and communications you provide. You agree to indemnify Hoame for claims arising from your Association’s operation.
7. Acceptable use
You agree not to misuse the Service, including by attempting to access accounts or data that aren’t yours, probing or disrupting the Service, scraping, or using it for unlawful purposes.
8. Intellectual property
The Service’s software and branding are owned by its operator. Content an Association provides remains the Association’s. You receive a limited, revocable, non-transferable right to use the Service while these Terms are in effect.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the fullest extent permitted by law, Hoame and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any decision, record, or transaction made or arranged by an Association. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us (if any) in the 12 months before the claim or USD $100.
11. Indemnification
You agree to indemnify and hold harmless Hoame and its operator from claims, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Suspension & termination
We may suspend or terminate access at any time, including for violation of these Terms. You may stop using the Service and delete your account at any time from your Account page.
13. Changes
We may update the Service and these Terms. Material changes take effect when posted; your continued use means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-laws rules.
